Role: You are the head of the discipline review committee for your district.

Goal: You and your committee are assigned to review of case of possible teacher negligence and the associated disciplinary action the District issued. A concern has been raised that the district did not follow proper HR and contract protocol in issuing its discipline. Your task is to determine if the District followed it Progressive Discipline policy and was the teacher’s assigned discipline appropriate given the circumstance.

Product: Based on the case, you are to share the committee’s (your) findings in narrative essay form outlining the following:

1. The details of case’s background and key details,
2. A decision concerning whether negligence on the teacher’s part actually occurred (why or why not),
3. A determination of whether the District violated its Progressive Discipline policy (why or why not),
4. A decision on whether the Union prevail in its appeal of the teacher’s assigned discipline (why or why not),
5. Cite your local school district teacher contractual language or your local district board policy language when you are making your argument determining whether or not this is appropriate discipline for the teacher and if the policy was followed appropriately.
6. Identify how this situation could be prevented in future circumstances.

Case Study

A teacher of special needs students transports five students to a local grocery store as part of work training for special needs students transitioning to adult life. The teacher has a bus license and drives the students using the school’s activity bus, which she has done on other occasions for other student activities. On that day, the teacher is also accompanied by a paraprofessional who assists with the students.

After the bus returns to the school, the teacher, paraprofessional and students return to the classroom. After an hour, the teacher notices that one of the students is missing and realizes she didn’t account for this child upon returning to school. She immediately gets coverage for her class, and drives back to the grocery store to try and find the child. She is unsuccessful. She returns to her classroom and teaching duties trying to decide what to do next. After another 2 hours, she notifies building administration of what has occurred. The child is later found by the Sheriff’s Department a mile from the grocery store walking alone on the side of the road. The parents file a lawsuit against the District for Neglect of Duty.

An internal investigation occurs finding the teacher was neglectful in her duties and endangered the child. She is placed on the Board agenda to be terminated. She has 22 years of successful teaching with no previous history of disciplinary problems. The Union grieves the decision, saying the District failed to follow Progressive Discipline and the teacher should receive no discipline at all. Did neglect even occur since the child was not injured? Based on your local School District Board Policy, will the District or Union prevail? Why? Does the District have the right to skip steps on the Progressive Discipline process? If so, what determines the circumstance? What is the appropriate discipline for this teacher? Should anyone else be disciplined in this case according to policy and if so, what is the appropriate discipline? What should the district and/or school do to prevent possible future incidents of this type.
